petitioner
and respondent remain under the same roof temporarily for financial reasons, both live completely separate lives, both agree the marriage has irretrievably broken down and consent to the divorce.
There isn''t a timeframe as such for you to return your application for the Nisi - but if you don;t apply then after a period of least 6 months has passed then the respondent can apply to ahve the
petition
dismissed and is free to raise their own one.
It will take at least 8 weeks from you returning the application to you receiving the date for your Nisi - if the divorce centre handling the applications is experiencing delays then this is likely to have an impact on the time it will take to process your Nisi.
You can start to resolve the finances at any time; once you ahve an agreement you should get a
consent order
drawn up by a solicitor - the consent order can''t be submitted to court until after the Nisi has been granted.
I have a quick question in regards to identification of my exwife''s signature.
Do I put a big A next to my wife''s signature? Is that all there is?
Is there any reqirement to write the respondent''s signature?
The only instruction on my D80B form is:
"I identified the signature appearing in paragraph 9(a) of the
acknowledgement of service
, a copy of which I have attached to this statement and marked ''A'', as the signature of my spouse, who is the Respondent in these proceedings."
I simply wrote a big ''A'' next to my exwife''s signature on D10.
