Form D8 was created by SteveLB
Hi
I am right at the beginning of the process and have a number of questions on form D8

Very brief background
Wife has gone off to Sweden to meet cyberlover, nearly been there a month, planning to return to the UK for 2 weeks then back to Sweden (she is co-habiting). No children, Married 8 years

I am petitioning on the basis of adultery

1) Can I put down 2 alternative addresses where the petition can be served (Sweden and UK) UK address is FH and could present it personally if courts pull their finger out

2) if number one is possible then do I need to send an extra signed copy to the court

3) at the moment I have put cyberlover down as co-respondent, does this complicate things

TIA

Steve

Putting down cyberlover does complicate things and really isn't worth doing. It means not only does your stbx have to be served with the petition and sign the acknowledgment of service but he does too...

i divorced ex on grounds of adultery (unnamed to keep it simple). He lives abroad, and I filed as normal with an address abroad, which got lost in the post.

Court then sent me another copy of papers to send registered which he received. But he has had to give an address in the UK for any further papers to be sent.

Ask DL as she told me there is a different procedure to file if they live abroad. I had already filed when I heard that.

Hi there

To keep this as straight forward as possible you should only use a UK address for service and you should not name him as co-respondent so that he does not have to be served.

If you use a Swedish address for her, you have to serve out of the jurisidiction via the Foreign Process Dept, which can take up to three months.

If you name him, not only do you also have to go through the same procedure for service, you have to have all documents translated into his mother language whether or not he speaks English.

I would save youself the trouble and time delay and just serve her here and not name him.
