Hi I need a little advice please, I have so far conducted a diy divorce and currently have a Decree Nisi agreement.
My other half has agreed that I am going to take on the family home and agrees to sign the transfer of equity form which I will pay for. She has also agreed on her settlement figure which I have offered to her.
The next step needs to be the signing of a document that cleary states we are both happy that her payment is a last and final settlement figure.
Question is can this simply be a document drafted by us and witnessed by a independent person/s or must it be via solicitors/court?

You need a consent order written by a solicitor, nothing else will do, the order must then be stamped by a judge.

A separation agreement is not suitable when you have a decree nisi .

Dukey pointed me towards a service that wikivorce do themselves re drawing up just a consent order , and making sure it is correct and sealed by a judge. As I was asking about it too, the link he sent me says it costs £99, but you can of course use a local solicitor, as dukey said to me.

I will see if I can find the link.

Or maybe dukey will send it to you.

A consent order must be written by a lawyer, what a layperson writes is worth nothing in law, it matters not who witnesses it bla bla , a consent order is drafted by a lawyer to dismiss future claims, the clauses contained are strange to those not familiar with family law, thus the need for a lawyer.
