Hello! I would be very grateful for some help completing Part 3 of the D8 form and can''t seem to get an answer anywhere else.

My question is this: My ex(the Respondent) is Brazilian, born, resident and still lives there.

I (the Petitioner) am British born and currently live in between Britain and Brazil (I work in Brazil) but spend a good couple of months a year in the UK, where I also have a house. We last lived together in Brazil, but registered our civil partnership in the UK.

Which part do I complete? Am I correct in thinking I am ''domiciled'' in the UK, and should complete this section:

''The court has jurisdiction other than under the Council Regulation on the basis that no court of a Contracting State has jurisdiction under the Council Regulation and the PETITIONER is domiciled in England and Wales on the date when this application is issued'' ?

or should it be the second part which does not include the part about the ''Council Regulation''?
