Unreasonable behaviour - thoughts please :)

This is what I have come up with - trying to be gentle enough not to cause an upset with the ex yet include enough to get me a divorce!! Can you let me know what you think?

The marriage has irrevocably broken down. As such the petitioner cannot be reasonably be expected to live with the respondent.

The respondent had recently started spending increasing time with his voluntary work with ATC and First Responding which takes up 3 nights per week and many weekends as well as other time away from home, as a result of this the petitioner feels that there were no longer any common or shared interests. Due to the behaviour of the respondent the respondent and petitioner spent less time together and as such the petitioner felt excluded and isolated from significant parts of the respondent’s life.

By spending less time together there had been a lack of communication between the respondent and petitioner which resulted in a complete breakdown of the marriage.

The activities the respondent took part in often cost money to execute and this put a strain on already stretched finances resulting in frequent arguments and the petitioner was left feeling distressed and embarrassed by having to request financial assistance from other family members on a frequent basis.

The Respondent never helped the Petitioner with household chores, despite the fact that the Petitioner worked part time, by way of example the Respondent would expect the Petitioner to perform all household duties, such as cleaning, washing, vacuuming, shopping and cooking as well as DIY tasks that were not completed by the respondent..

The respondent himself was extremely disorganised and untidy which left the petitioner feeling embarrassed and unable to have friends or family into the home, by way of example in the last few months the respondent was sleeping on the sofa and as a result of this the living room would regularly be littered with dirty clothes, bedlinen and pieces of computer that were awaiting repair

As a result of the Respondent’s unreasonable behaviour, the Petitioner found it impossible to continue living with the Respondent. Consequently, the Petitioner permanently vacated the former matrimonial home on the 11th day of March 2012 since when the Petitioner & the Respondent have lived entirely separate & apart.

Hi Belle,

It''s not easy is it? Writing all this down, getting the wording right, writing about the breakdown of your own marriage :(

I think that what you have written is fine, the only slight change I would suggest is that you change "The Respondent never helped the Petitioner with household chores" to something like "Recently the Respondent refused to help with household chores"; as you know, the behaviours and examples of need to have occurred during the last 6 months of you having lived together, so by adding the word "recently", this suggests that his lack of help with the chores is a more recent thing, and therefore fits in with that 6 month time-frame.

Personally, I would put "The marriage has irrevocably broken down. As such the petitioner cannot be reasonably be expected to live with the respondent." last, right at the bottom under everything else.

Well done - it''s clear, explains how you have been made to feel, details the respondent''s behaviour, some specific examples of the respondent''s behaviour with dates might help, but I think it''s clear from what you have written that the marriage has irretrievably broken down.

When will you submit it to the Court?

I am planning on running it by the ex so he knows what to expect then submitting later this week if he is ok with it. I have completed everything else ... in triplicate Lol
