Decree Nisi was created by ian54
Im trying to progress a DIY divorce , my ex is dragging her feet on a few issues though we have agreed on most things. I would like to obtain a decree nisi so i can remarry, is their any reason i can''t apply for this even though a full financial settlement is still outstanding. Any advise welcome.

You can''t marry again without having the Decree Absolute - a Decree Nisi doesn''t dissolve the marriage; you would still be legally married with a Nisi - and until you obtain an Absolute.

It''s far better to have the finances agreed upon and set out in a consent order before applying for the Absolute, esp if you are planning to re-marry again in the very near future.

Have you tried mediation to sort out the remaining issues?

She can ask the Court to delay granting the Absolute until the finances have been resolved - it''s probably best to focus on finalising the finances from one marriage before beginning another.

oh sure but if she is dragging her feet to frustrate me then i guess the Court will not be sympathetic to her?
