Does anyone know whether the grounds for divorce have to be the same when applying for the decree absolute
as those used for the decree nisi?
My decree nisi
came through nearly 3 years ago, and neither my husband nor I have applied for the decree absolute
. Grounds were unreasonable behaviour. We have lived separately since the decree nisi and would now like to finalise our divorce. Can I apply for the decree absolute on the basis of 2 years separation? Or do we need to stick to the original grounds of unreasonable behaviour.
The Absolute just confirms the Nisi you don't have to quote any more reason.
The granting of the Nisi confirms that the Court have accepted the reasons for the divorce. If no one comes forward within the six week period with a valid reason why you should not be allowed to divorce then you can apply for the Absolute.
The Court may want some explanation as to why the application for absolute
has been left so long.
