Yet another question I'm afraid ...

As the stbx and I are no longer living together the statement:

(12)
(a) The respondent has committed adultery with
a [man] [woman] and the petitioner finds it
intolerable to live with the respondent.


seems to be a little misleading.

Would the judge not see from our addresses that we are already no longer living together?

Should I not put something else like 'finds it intolerable to remain married to the respondent' or does the wording have to be just so?

Dont deviate from the standard wording - your petition will be rejected. I know it is strange, but law is.....just roll with it hun. Best thing is not to think about it too much - some would say that lawyers find that part of the job easy ;)

It doesn't say that you are living together, but that you would find it intolerable to do so after the adultery.
