We have our final mediation session today,please tell me what is the next stage of the process,ie if it breaks down today where to next?..also if we agree financial settlement today what happens next....does all the paperwork get sent to our solicitors to be drawn up and thats it? we get decri absolute?...decri nisci was march 18th 2009.

Hopefully you will be able to agree if so the mediator will draft an agreement that will be sent to a solicitor to be written as a Consent Order that is legally binding once the nisi is made absolute.

If you cannot agree the petioner (in most cases) will file form A with court and you begin the long and expensive court process.

Its well worth remembering the court route can cost many thousands so if your close to agreeing do so its not worth fighting over 10k the cost will outwiegh the gain.

well it did break down...i stood firm and said i wanted 32.5k,plus 5k towards joint debts we have.....im taking on 10k of them..she said her final offer is 26.5k and i keep all the debts,so we are 11k apart........basically we have 66k equity in property,so i can see where she is coming from she offering 40%...
where do i go from here,she is the petitioner.

i would think very carefully, 11k will not pay the solictors costs if this is contested through court, some wiki peeps have spent 30k+ contested to final hearing, can you meet in the middle? think of it this way if you go to court over 11k and it goes all the way to a final hearing for a judge to decide it could easily cost 30k, no one wins you both loose.

talk to your wife try and agree save the stress time and costs.

OK I SEE WHAT YOU MEAN,SO CAN WE STILL AGREE OUTSIDE COURT NOW EVEN THOUGH WE HAVE USED UP OUR mediation SESSIONS?IVE LEFT IT THAT HER SOLICITOR CONTACTS ME,NOT MY SOLICITOR,

Yes - keep talking and see if you can agree ..

You can agree on the court steps outside a Final Hearing if you get that far ;)

And if you do agree, get a Consent Order signed and in front of a judge please - you don't want to have to start over a few years down the line.
