2nd mediation session yesterday and STILL waiting for soon to be ex to provide all asset valuations. However he's been very quick to provide a credit card debt for a card I knew nothing about, plus 3 loan agreements between him and his mother! totalling £40k! again I was unaware although I'm fairly sure that they were all gifts, particularly the one that was given a month before our wedding!
HE produced 3 'loan agreements' in mediation. 3 identical sheets of paper, clearly written and printed at the same time (despite spanning 5 years) that simply say the amount and that they were for 'home improvements' and not witnessed. Just signed by my soon to be ex and his mother! These are clearly fake! There are no repayment terms and no repayments have been made. Do I need to even bother 'proving' that these are fake or will his lies be seen through given that he definitely can't prove that these were 'loans' (because they 100% weren't!).

Also with the credit card, given that the agreement is between him and the lender am I even liable? He keeps changing his mind but he now says it was from before even met.

This is so frustrating. Is it even worth me pursuing with mediation or should I just go to court. I wanted to avoid the expense but not sure I have a choice

Hopefully someone will be able to advise on the 'loans'.

You will not be liable for a credit card debt if it's in his sole name.

Ref credit cards. Think you might find that if the money was spent on the card during marriage the 'debt' goes into the pot with assets.

Ref. money given before marriage.
Not good news there Im afraid. I brought half a house plus inheritances into the marriage and that went into the pot. Its a case of 2 become one when you sign to say you are married.

Except that my soon to be ex thinks that that rule only applies to his debts and my assets (I have a mortgage free flat that I've already offered to sell), while he is claiming his overseas property in a very desirable area and a business interest are now 'worthless' :unsure:

Yep I had the same where I always had a big question regarding her business and the purchase of the business building. For tax purposes(complicated) it would have been better to incorporate the building into my property portfolio. Nope she preferred to rent it to herself (complicated) but kept building in her name even though it was very disadvantageous tax wise.
Why? It was a classic case of whats mine is mine and whats ours is half mine.

Yep half my house brought into the marriage went. Half my inheritances went.

Now my case would not have been so bad but her business building was bought 15 years previously. Its called forward planning.

This site should be compulsory reading before anyone agrees to get married !!

The good news is karma works in mysterious ways and you can pop down Ladbrooks and put a bet on who is doing better now !!!

That is good news! I do believe in Karma. I know I'll be ok no matter what but I refuse to lie down and let him walk all over me! Thanks for the reply
