just before the tenancy was coming to an end on our investment property and my wife took the decision to move into the property with no agreement in place, just because she was \"fed up\" take all furniture she wanted and take the children too, weeks leading up to that i booked an appointment with a mediation service and attended the MIAM then booked an appointment for her to attend which she declined to go to, and only after going down the litigation route she attended on her terms just to receive the certificate disclosing no information to the mediator other than she wishes to go down the litigation route instead, i have to asked myself was this calculated, can anybody tell me why i should not think this way?

We aren't mind-readers, and don't know your wife so it's impossible to say for sure why your wife has declined mediation and opted to go to court to resolve the finances.

I think, instead of trying to work out what someone else is thinking, or what thier motives are for taking a certain course action, you would be better focusing on yourself, your own well-being, and what you need to do to prepare for the first court hearing.
