What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

Please forgive my ignorance but does it make a difference what band your solicitor is?
I have received aletter today from minestating she is a Band C solicitor and stating her costs.
She also states she works under the supervision of the head of family law who is ultimately responsible for my case.

Its about billing cost Julie, your solicitor is junior and supervised and as such charges less than lets say a partner in the firm would.

Lots of new solicitors are, keen full of knowledge and keen to grow through experience, it takes years to reduce them to soulless husks of their former self :(

A. Solicitors with over eight years post qualification experience including at least eight years litigation experience.

B. Solicitors and legal executives with over four years post qualification experience including at least four years litigation experience.

C. Other solicitors and legal executives and fee earners of equivalent experience.

D. Trainee solicitors, para legals and other fee earners.

The bands are not meant to pigeonhole people, they are merely guides to the ability of lawyers who carry out work.

If a solicitor specialises in his/her area of work and has done so for 6 years (plus two years training), they would probably be more proficient that a general solicitor who has 10 years under their belt.

A grade C solicitor is still a solicitor with between 0 and 4 years experience.

The current rates accepted by the courts are in the link below. These are average rates which means that some charge higher and some lower. All rates are, of course, plus VAT!

Thankyou Charles that is very close to what I have been quoted.

I am lucky to have got one who is still keen then Dukey, unfortunaly for me she is not suggesting taking my stbx for all I can. Only joking I would like a fair settlement but that depends on who is pulling the strings with him. Only time will tell I guess.
