What are we each entitled to in our divorce settlement?

What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

Is it possbile to retrieve historic case files from solictor firms that are no longer an active business?

Anyone done this before or know how to go about something like this?

Solicitors usually keep files for 6 years before destroying them although some firms keep them longer.

Where a company has gone out of business there would normally be a successor firm which would take on the remaining files.

If there is no successor firm the partner or partners would have to obtain run-off insurance to cover any potential future negligence claims for work carried out and they may have the old files stashed in a garage somewhere.

To find out if there is a successor practice you can contact the SRA who should be able to offer guidance www.sra.org.uk/home/home.page
