What are we each entitled to in our divorce settlement?

What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

Hi All,

If applying for Legal Aid would a solicitor ask for a deposit ?
ex wife has been to see her solicitor and paid him £500.

Does this mean she has or has not got Legal Aid ?
I'm trying to find out if she is trying to claim domestic abuse a that's the only way she could get Legal Aid.

Thanks

A solicitor would only usually take monies when providing private paying services.

If a person is entitled to legal aid they would not need to make a payment unless they had to make a contribution from capital over and above the threshold amount when assessing means.

A typical first payment of 'monies on account' would be £500 or £1000.

Thanks Charles.

So based on this is it safe to say she hasn't got Legal aid ?

Thanks

Not currently. If a person has access to £500 they are unlikely to be entitled to legal aid!
