What are we each entitled to in our divorce settlement?

What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

The 'prayer' is like the legal term for the divorce application form. It has all yours and your STBX's personal details on it. Link below will take you to it:

www.wikivorce.com/joomla/component/optio...func,startdown/id,8/

Ancillary relief is the process of resolving the finances between you and stbx. Follow the link below:

Hope it helps,

Mike

Simply put the 'prayer'is an oath swearing that it is true 'to the best of your knowledge and belief'

Ancillairy relief, is the finacial part of sorting out the divorce, agaim simply put it is the division of marital assets and liabilities and both of your current and future earning potential, there is a bit more to and it depends on a few factors of which there are 12

some more informaqtion is available on this site and indeed on the web itself, do not go on heresay as this leads to confusion, do not rely on anyone else's opinion either look it up yourself and understand what it means

If you can afford it, use legal assistance where neccessary, do not rely solely on what you think you are entitled to, the law is grey not black and white and considers every case differently, but uses the acts of parliament to come to a conclusive state

For example there is no point asking a solicitor, 'I've got 2 kids, how do I stand" the law looks at the childrens interest first so all you will be doing is paying a solicitor £150plus per hour to answer what you can find out on the web.

So you would save some money, by looking up and understanding how it works, you cannot know for certain because one judge might award differently to another, but they will be very close

Hope this bit helps a little
