I was in court on the 19th January, and it was decided that CAFCASS would be involved. Since then though, we are still waiting to be assigned a CAFCASS worker.
I recieved a letter in the first few weeks asking me to fill out mine and my daughters details and I sent that back.
I recieved another letter a few weeks later saying that there was a long wait, and that they would be assessing our case to see if CAFCASS needed to be involved or if mediation would be a better option.
My ex though refused to go to mediation before we went to court, and insisted we go through the courts.
If CAFCASS say to do mediation and he says no, what will happen?
They are supposed to be doing a section 7 report, so would they be able to pass that onto mediators?
Thanks in advance

Hi
I think mediation is required (if appropriate) if you're on legal aid, CAFCASS have very long waiting lists and so can pass on to Social Services to do a section 7 report.
Hope this helps

i have had nearly a 30 week wait for my CAFCASS report(court ordered back in sept last year). Ex initially refused to go to mediation, now the court date is approaching she has changed her tune(in front of the CAFCASS officer and is now is totally for mediation, mind you she did admit to the officer that mediation was possibly too expensive for her, he did remind her that going to court was far more expensive) i have to laugh at that comment. Think she is trying to delay things, but we shall see, miracul;ously she has agreed to overnigh, but only back to what she agreed to at the time of the split, wwhich is equivelant of one night a week, and some holidays and NO to alternate xmas. will see what she says at mediation, if no to alternate xmas, well wil let the judge tell me i cant see my chidren at xmas and not her.

The standard unless there's something awful you've not mentioned is alternate weekends plus half the school holidays so i'd guess you'd do better in court

Oh ok, thankyou. We did try mediation a while back, but due to being on legal aid, could only have 3 sessions. After we finished them, we had to wait 3 months if we wanted to go back. It was after those three months that my ex applied to the court, and I asked to try mediation again and his solicitor said "the request to mediate is unreasonable".

Also, what will they actually do? As i've heard a lot about wishes and feelings report, but seeing as my daughter is only 20 months old, she can't really say what she feels! Someone before mentioned a supervised visit between my ex and my daughter?

Thanks =]

I waited for 3 months passec the submission date for the report, i found that i would ring them every 3-4 weeks for an update on my case. I think they got fed up of me and pushed it through. Good luck and dont give up it taken me nearly two years and i have managed to get 3 hours a fortnight outside o a contact centre, but there is always light at the end of tehh tunnel.
