I'm new here and in a panic. My ex and I have been split for 6 months now and I have had primary custody of our 2 children. I have recently begun a custody hearing due to some personal reasons. Now my ex has decided since I am taking him to court that he wants 50% custody. He works full time and I am a full time stay at home mom doing correspondance. He wants his girlfriend to watch the children while he is at work during his week of having the kids. Do you think he will get custody? They would be in someone else's care for 10+ hours a day with him and I don't think that's right or fair to our children when I am here to take care of them. Thanks in advance for any response.

How old are your children? Does your ex live locally to you?

Were it your ex with them full time on 'his' week, I could see that being a workable arrangement, but being his new girlfriend, not so sure.

I take it that the children have only been recently introduced the the new girlfriend?

What do the children seem to think (of they are old enough to express themselves)?

My children are 2 1/2 and 8 months old. They are still babies. My ex moved her in after knowing her for a month so my children have known her for a bit. She is apparently very good with them but she is not me and can't offer what a mother can offer them.

He gets them every 2nd Saturday overnight until Sunday when he chooses to bring them back (usually around noon by his choice) and the same for every second Tuesday overnight until Wednesday. This is what he had asked for. He is also allowed to see them any other time as long as he gives me notice.

Don't know about Canada, but here, courts are unwilling to change from existing arrangements unless there is a very good reason to do so.

Given their ages, I think that is a satisfactory arrangement.

I hope that rings true here. He has told me if I don't go ahead with the court case he will drop asking for 50% but I don't know if I should since there was obviously a reason I chose to pursue legal action in the first place.
