Children''s passports

Please help..

I have shared residence of my sons, twins aged 8 since 2008. Divorce went through in 2010 and finances finally settled last year. All aspects bitterly battled over by very difficult and resentful ex wife. Recently applied for passports for my 8 year old twins to take them to Florida Disney.

Just been told this morning that passports already issued to mother last year. She denies she has passports. The passport service will not issue more than 1 passport.

From previous experience I know my ex will seek to obstruct me at every opportunity.I fear I will have to go to the County Court again. I do not want to spend any more money with solicitors...already £25K down...

Need advice as to how to go about bringing the matter before a county court and getting hold of the passports...

I think you should write formally to your ex and state what you were told by the passport office and ask her politely to either send you the passports by return or inform the police and passport office they have been lost so that new passports can be issued. If the matter still can''t be resolved you can then apply yourself to court for a Specific Issue Order for the passport to be handed over and use the letter as evidence that you have tried to resolve the dispute reasonably.

The passport office state that the LOS form must be presented by my ex...not me...
She is intent on forcing and creating problems and I have no doubt that I need to go to court..
I would like advice as to how to make the application, forms used, wording so that the judge doesn''t throw it out on a technicality..

Information from the Passport Office.... particularly pages 34 & 35 for information.

The Passport office will not get involved in disputes.. Do as Fiona says and write the letter giving 7 days for a response.. If you have no joy go to court, use the letter you have from the passport office to show the ex has been issued the passport..... When you get to court ask for costs due to the ex being difficult.. Any probs get back to us...
