Hello

I am going to a final court hearing next month. We have one child whom is 13 years of age. I moved out of my house in 2021 and still no settlement has been agreed, This is the reason for the final hearing ( Financial ) Through mediation we agreed a 50/50 split in 2022 with our child. So 3 days a week then 4 Days alternating. However over the last year my son just comes to my home ( rented) ( Wife lives in mortgaged house) and for the last year it's been 4/6 days a week he sleeps at my place.

Every day he does go to his mums from school till I get home. Then makes his own way to my place.

The question is how would I prove this at a final hearing? she does receive all the child benefit. We do have an agreement for 50/50 but it is my son whom refuses to stay there.

I do understand that regardless of the outcome of the final hearing. My son will end up staying with me the majority of the time.
