I''m being contacted in Switzerland for a REMO clai

Hi, I have bene contacted by the Swiss Government with regards to a REMO for child support. I''m am very sure I am not the father of the child they are saying I am or as reported by the Mother. Does anyone know what my rights are or how best to deal with this? Do I just elect to have a DNA test?

Any help or advice would be great, thanks ....anxiously.

I think the onus is upon them to prove you are the father not upon you to prove you are not.

I''ve also just done the time calculations and unless the baby was severely premature it is impossible for me to be the father.

Can they get a court here to enforce payments or are you saying that they need to prove I am by getting a court to make me submit?

Its actually for you to prove you are not the farther (In England and Wales) i can`t remember the name of the main body for DNA testing i think it cellmark i`m sure another member will know.

Long story short you need to prove your not the farther to end this.

Thanks, Im happy to submit a DNA test to end this - do they accept a verified courst appointed teseter or would it be through one of theri own??

I thnk you will need to contact the issuing court to make clear you are not the father. They may then be able to order DNA testing to prove this.

In the UK, courts will only accept DNA tests carried out by labs which are licenced by the Home Office for the purpose - Orchid Cellmark is probably the best known, the others are listed here www.justice.gov.uk/courts/paternity-testing/paternity-test


If the order has been made in Switzerland, and you are in the UK, then the Order has been made by a Swiss court, and the Uk court is only enforcing.
If you are in Switzerland and the order has been made by a UK, being enforced in Switzerland, they you will need to apply to seset aside the order. The Court can order DNA tests.

Thanks for the advise. I have only just received a letter from what looks like the "social department" asing me to claim parentage of the child and requesting that I go to the Embassy to register as the fatehr and arrange child support based on my earnings. The leeter state:

" The parents advisory centre regulates on behalf of the Guardianship Authorityof the City of Zurich the legal entitlement of children whose parents are not married. This includes acknowledging the child by father and regulation of support. Mrs ***** informed me that you are the father of her child. In order to register you as the father it is important that you prform the acknowledgement of paternity at the registrars offcie of your municipality. This acknowledgement must be certiied at the foreign office and then the Swiss Emabssy in London (address supplied). the Swiss Embassy will then ensure that you are registered in the civil register in the Canton of Zurich as father. Please carry out the acknowlegdement of paternity by the 30th April 2012. We will also need evidence of your income and assets, as you are responsible for support of the child as the father. Please return these documents to me by the 20th April 2012. if you have furtehr questions, pelase dont hesistate to contact me either by telphone or mail."
