I have been paying weekly amount to ex as decided by CSA since August 2010. I can''t remember how it came about, but I pay directly to ex. I say I can''t remember because due to stress of separation and divorce I have been ill and off work for much of the time since then.
So, I have not reclaimed money for nights my kids have stayed with me and from autumn 2011 I have also been on half pay and have not changed payment at all. I have also been paying for other activities the kids do.
Now that I am feeling better and back with it, and have been left with little capital after divorce, I have calculated I have overpaid by about £6000 in CSA payments. I have called the CSA to explain I was too ill to inform them of nights my kids stay with me and my change of circumstance at work, but they say because I pay directly to my ex and not through them, they can do nothing about this overpayment and I will have to work this out with my ex. Obviously my ex won''t just give me money back.....so my question is....is this correct, have I no way of retrieving this overpayment, e.g. by paying less over a certain period, or can I complain to someone? CSA do now have my correct details to reassess payments from now.
Sorry but as you havent been paying cm via the csa, your payment would be considered a private arrangement and so there wouldn''t have been any ''''overpayment'''' as such so I dont think there is anything you can do about getting the money back unless your ex agrees.
I would start paying the correct amount and accept you have lost the other money.
