Quick question regarding court orders.
We had a Contact order done in September 2010. Since then, we have had two Contact and Specific Issue orders, the last one being in January 2011. This was the final order, and the court was dismissed.
Does the contact order from 2010 still stand? Or is it void now? How long do court orders generally last?
The most recent order usually stands as the contact issue is not something that can usually be set in stone. If the original order was varied by a subsequent order, that variation will remain until a later order says otherwise.
In your case, you should read the orders as a whole as it may be the case that some Directions were varied or deleted and others may be added or substituted.
Orders last until the child/ren reach adulthood or until variation by a subsequent order.
My mistake, there is just one order following the 2010 one. The bit I am wondering about, is the fact that it says we have to have permission of my ex or the court, to leave the jurisdiction in the court. We are going on holiday in a few weeks, and dont know if this is affected.
It appears in the first bit. It starts with
Upon hearing counsel... Etc then it is
And upon (the mother agreeing not to remove child from jurisdiction of court) [not the exact words]
BUT then there is the
IT IS ORDERED that: and then the order.
So i''m confused!!
The newest order, discharges some points of the old order, as they were not done by a certain date (the ex didnt do them).
So i''m not even sure if it is an order, as its just at the top, rather than in the order?
