Hi,I want to apply for a remission 2 of a EX160A form,I work and receive monthly payslips,claim work and child tax credits for 1 child,also receive child benefit.All i want tk know is what exactly i need to take to the court to prove my annual income?do i need all paperwork from last tax year or is it a year back from this month?please help with that,thanks

Hi, for remission 2, based on what you''ve put you''ll need to provide:

Your last months payslip, and it has to be less than 6 weeks old.
Your last 3 months bank statements.
A child benefit notification (dated within the last month)
A tax credits notification (dated within the last month)
Any CSA/CMS assessment that you have (dated within the last month)

Unfortunately we''ve had lots of reports that fee remission applications are being rejected, even where the income is below the thresholds. and all the evidence is there. There is an appeals process but it''s time consuming so if your application is fairly urgent it might be better to find a way to pay the fee. Otherwise it only costs you the time so there''s no harm in trying it.

All I needed was an up to date working tax letter. I called them and it took 3 weeks to arrive. When I went to the court that''s all they needed, very quick, straightforward.

If you receive working tax credits but not child tax credits then you apply under remission 1. Remission 1 is automatic, as long as you provide evidence so pretty simple. The reason is that when you receive this benefit or one of the other listed benefits, you will have already been income assessed (either by HMRC or DWP) so there is not much point in HMCTS doing it all again.

If you get child tax credits and none of the other listed benefits you have to apply under remission 2 or 3. These require much more evidence as you have not previously been income assessed.
