Afternoon All,

A quick question I have had my DN through, I petitioned on the grounds of UB and applied for costs against the stbex when will the cost of divorce be brought up and if agreed
be paid.

If the court makes a costs order - usually at the Decree Nisi stage - you need to detail what costs you have incurred and send this to the respondent.

If you acted in person your costs will be limited to the court fees (including for the Decree Absolute if your Petition court fee was £340 rather than £410) and, if you incurred these: marriage certificate fee, bailiff/process server fee, oath fee.

the certificate of entitlement to decree Nisi will specify that a costs order will be made unless the respondent objects to this. If no objection is received, the costs order will be made at the same time as the decree nisi is pronounced (granted).

Do you have a notice of hearing at all? This should clarify issues somewhat.

I had that also, my stbx objected on the main application to paying costs but as he didnt make an application to go to the pronouncemnt of the Nisi they awarded costs against him. (not that I actually have any costs as I was LIP and luckily got the fees remitted due to me being on benefits as I cannot work at the moment due to being a registered carer for one of my children and her being at one hospital or another for check ups, treatments etc)
