After 7yrs yrs of living seperate lives but under the same roof, I ended my marriage of 21yrs in Jan 06. Having told my husband I then wanted to seperate and sell the family home, having given the children a good up-bringing, he went to the courts the next day & got the paperwork & paid the court fees for the divorce up front.
I filed for divorce & he was amicable to it once he realised there really was no way back for us.
In March 06 the decree sought was declined as the district judge deemed that we had not lived seperate lives until we had agreed to sell the home in Jan 06.
At that time I did visit & speak to somebody at the courts & also wrote to them, as I wanted to clarify if it was as simple a procedure as sitting & waiting until Jan 08 then renewing the request for directions for trial, but got absolutely no where!
I have now renwed the request for directions for trial as the 2yrs have passed, but am wanting to know will the court fee's be payable again? My husband at the time told me he'd paid £300 on the day he picked up the divorce papers, as it never proceeded at that time was the fee still payable & I therefore will now have to pay again or what?!

Sorry for this to ramble on, but I can not afford that amount of money right now. I feel there is some sort of confusion where the fees were paid up front & from what the guy at the courts told me, this was not the normal!

Husband is pressurising me for the divorce to go thru & for me to chase it up, primarily I feel to secure his finances, ie. pension, shares etc. I gave him my word at the time that I would take nothing from him & still stand by that. The family home was sold in Aug 06, son of 21yrs lives with his dad & 20yr old daughter lives with me. I am more than happy to continue with the divorce proceedings but my only problem is that I do not have the finances to afford it if this is the case. If anybody can advise I would be most appreciative.
