I would like to say a BIG Thank you to all the wiki members who answered my questions and for the GREAT advice on this website.
I went to the 1st hearing self repping.
basic outline
W33, H33
Salary: W under £7k, H on benefits IS/CB/TC
Assets:
FMH £215k mortgage £180. Deposit, mortgage payments and bill paid by W
Debts: H=£1k, W=£0
Children: 1 x 2year & 1 x step child 7 yr(H child only living with H)
No pensions
W savings £3k, H None
W in FMH, H in council permanent 2 bed flat
H was questioned why he is not
working, he cities after school care not being provided at 7 yr old school.Judge said should get work ASAP, as W with 2 yearold is working so no excuse.
H requested £15K to be put in trust for 2 yr old (self repping after legal aid was revoked), (he''s previous solicitor was requesting 50% of equity saying house was worth £260k). Judge said not possible at this stage. He must accept an amount for himself.
Judge then asked me what I could offer, I said all savings except over payment from Tax credits, so £2,500. She asks me if I want maintence from him as I have a 2 year old? Judge asked H if he would accept savings, then gave 10 mins break for him to think about it.
After Break she asked if he will accept. He says ok then, I say no maintence as I have never relied on anyone, but judge is reluctant about the NO maintence. Thinks H will be rolling in it when he is in work!!
All agreed No maintence for me,
Clean Break, H gets £2.5K. I get the deed of entitlement lifted off the house and FMH is solely mine.
So releieved this has been haunting me for 2 and a half years.
