Sale of FMH or to go to Auction!!!

This seems to be going on forever. Had FH in Feb finally received draft order in April but had to wait until July for a handing down hearing, in which the Ex appealed so had to attend....still not had the sealed Court Order which looks like will be the beginning of Aug.

However the Ex wrote to the court prior to the handing down hearing and requested that if the FMH was not sold by 6th August that it was to be sold by auction. I sent a response and asked to be given 6 months and then if still not sold then go to auction, especially due to the housing markets!!! Anyway at the handing down hearing the Judge met us in the middle and said if the FMH is not sold (exchange of contracts) by the end of OCT that it would be have to be "sale by auction". This is all due to the ex and him claiming i will be stalling the sale etc, for my own benefit :angry::angry:.

Can anyone advise me if we have still not completed by this date and the Ex raises this with the Judge will we have to pull out of a hopefully nearly completed sale?

The Judge did say her main priority was our daughter who lives with me 100%. If it does goes to auction we will be homeless whilst I proceed to a purchase something. Surely it would cause more problems to pull out of a chain to sell at auction? What are the chances that this would actually happen?

I can''t believe i have been given only 3 months to sell the FMH which me and daughter live in,and buy a property, the Judge pointed out that the markets are stagnant as well as she use to do conveyancing, so knew the procedure very well!!! :unsure:

I know I''m running way ahead of myself, but should I write to the Court at the end September and update them of the probable sale time if it is expected to pass the deadline set?

I know the Ex is going to be awkward and will get great saitisfaction going back to court and use it as another opportunity to insult and run me in the gutter.
