waiting for Form E ...

what a nuisance...
I'm already waiting for stbx's form E since 23 days. Deadline was 7 Feb 08. No reply from his sol so far... What would be the average delay? Is there anything I can do to speed it up a bit (I put in so much effort to get the papers to court in time

Delays are very common and there are many reasons for delay

Some true and quite often just delaying

Its early days but you can force the issue if you belive the delay is unreasonable

Can you contact your spouse and ask?

we are not on speaking terms... so far he has ignored all my calls, mails, etc.
I do not believe that he's got any good reason for the delay. How can I force the issue? And when would it make sense to speed it up a bit? Well, the FDR is in June but I don't believe that I will have his Form E by June, so the FDR would be delayed, right?

Both parties have to submit their Form E's prior to the FDR - it will be ordered by the court and their is a deadline date set by the court for the sworn Form E's to be exchanged (this usually happens through solicitors, you can send your Sworn Form E direct to his solicitor - you don't need do do it via one - if you ask your solicitor to give you Ad Hoc advice this will keep costs down a bit. The FDR will not be a long hearing - usually they are set for 30 minutes but their is negotiating done (usually between the two barristers before you go before the judge). Unless you think you will be able to come to some agreement the FDR will not be fruitful, more negotiating will take place and this is where costs can soar - especially if it goes to a final hearing. There is a lot of paperwork - statements - etc etc to cover and the process is long drawn out - there can be as much as 3 months between hearings.

Sorry to sound a bit negative but I have been through it very recently so I am just being honest and realistic.

Hi Elizabeth, the court has already ordered that Form E should arrive at court by 7 Feb 08. Mine was there in time - my stbx's E is still missing. This is what pisses me off - what's the point of a court order if it cannot be enforced?
