Hi all my partners ex-wife won't come to court for the financial hearing and has not filled in her from E despite being ordered to by the Judge twice now , at the last hearing he said this is her last chance she either appears or he will order her in contempt and she will be fined and face a possible prison sentence , He has paid for the mortgage and all her bills even phone and tv license ! for 6 yes thats right 6 years !!! but this is still not enough , we want to get married next year and just want to get it sorted out so we can get on with our lives , both kids are grown up and left home over 5 yeasr ago , so no dependants and she just will not communicate with him or the judge or her own solicitor , can anyone suggest what to do , she is living scott free at the ex marital home while we are paying for it , can't stop mortgage payments or it will blacklist us so we won't be able to get a mortgage when it is all over , please please help anyone !!!

Civil proceedings can be held in absence of a party to the action that repeatedly fails to appear and/or cooperate. Arguements about rights to a fair hearing may result....however you point out that the Court has proffered her every opportunity to be heard.
