Ex refuses to discuss exchange dates?

Good Morning,

I have filed for a Financial Settlement, I have the Notice of First Appointment and when the different forms have to be filed.
However, I have emailed my Ex husband and suggested 4 different dates for exchanging form E's and statements etc, and he's replied saying he will not discuss it with me?

Do I just send my forms to the court, and not him, or ignore his protest and just go ahead with my suggested dates, regardless of whether he will be sending/exchanging his?

The date for exchange is set out in the notice of first appointment.
Does he have a solicitor??
If he does, you need to communicate with them.

Whatever happens you should file your form E with the court by the appointed date.

As to the other documents, if you don't get his form E, you can do the chronology. Submit the form G to indicate the hearing cannot be FDR because of non disclosure. Do headings for the questionnaire and statement of issues. Note on each that you have had no form E. Put down the issues as you understand them ...so things like should FMH be sold, how pensions should be divided etc and indicate there may be more to add once you have sight of his paperwork.

Thank you,

I do not believe he has a solicitor, nor has he directed my attempts to communicate towards one.

We have to file our Form E's by 5/2, and as this is a Monday, I suggested the Wednesday beforehand to take into account any weekend post delays.

I shall still file mine by the 5th, do I assume I still have to send him a copy even though he refuses to exchange?

It is only an exchange if you both do it. File yours with the court and send him a communication (ideally by post) to state that you are ready to exchange, have filed yours with the court and are awaiting confirmation from him that he is ready.
