Yes - your STBXs immigration status needs to be taken into account in both cases.

Whether or not your ex:
a) qualifies for permanent residence in the UK and plans to stay in the UK
or
b) will leave the UK
will clearly impact both their financial needs and the practicalities around child arrangements.

Their residence status and intentions of where to live should be established first. Then the finances and child arrangements can be discussed/negotiated based on where they will be living.

I assume its fairly obvious that them being in the UK or not will greatly impact the child arrangements.

It will also impact the financial settlement as it is largely based on their financial needs (and their income) - which will be different based on which country they will be living in.
