I am trying to work out whether it is worth making a D11 application to vary or change the directions made following the first hearing in my ex husbands financial remedy application against me.

I am a LIP because of finances. In the properties to be valued, the house my ex husband lives in was left off the list as it was deemed we had agreed a value, our estimates were within about £10k. A house that I own on paper but I have no beneficial interest in (it belongs to my Dad, its only ever been his home, its in my name because he was too old to get the mortgage he needed to top up the money he had to buy it ) is on the list.

We were £20k apart in our estimated valuations but this property is worth going on for twice the about of my ex husbands home, so percentage wise our estimates were the same. I do not understand why one should be on it and one not.

I have made my case to his solicitors, asking to either add his or take off my Dads but they wont budge voluntarily. I really don't want my 81 year old Dad who suffers from dementia being upset by someone coming into his home. Today his solicitors have said he will agree to not having it valued if I agree on a bigger estimate than was in either form E ? They said 'on reflection he is not confident in his estimate etc etc.

Do you think its worth making the application ?
