Hi, My partner trying to ge S2BX to agree to a consent divorce, matter negotiated for the last year. legal bills must be big at this stage.
His last offer gave S2bx all she has asked for EXCEPT payment of her legal bills. She has not responded to offer. She is in default of court order to file her papers.

What can he do? It seems there is no recourse if one party simply refuses to comply with court orders ?

How can this be moved through the courts to get resolved ?

Hi Dun,

From my experience there IS nothing on eparty can do if the other doesn't comply with court orders to file papers.

The court will insist on following the FA, FDR, FH procedure and the fact that the othe rparty hasn't complied may earn your partner a brownie point and award costs or some measure of them against your partner's stbx.

The offer he's made will have to be presented to the court along with any other offers, counter-offers and proposals.

What stage of the proceedings are you at?

Nowadays, the Courts expect each party to pay their own bills. Since she is the procrastinator, I think your ex would not be Ordered to pay her costs. Maybe now she's realising just how much she's wasted!?
