I'm getting divorced which isn't what I want but he hit me so no going back. I'm suffering with stress and depression and have been prescribed diazepam, will he be able to use this against me with regards my 11 year old daughter?

I don't believe so. Depression is an illness that is very common in divorce cases - either before or after - and is quite reasonable given the circumstances. You are being treated for it and presumably are under medical guidance. It could only be used against you if you were to present a risk, which I hope and trust you don't. Wishes for speedy recovery.
