Hi my partner and I AV been together for 8 year but he has not been divorce his x wife has been in a relationship for 9year they both have been apart for 10 year does he have to pay for a divorce .

Providing there are no children of the marriage that are aged under 16, and there are no outstanding financial matters, your partner could divorce on the grounds of 2 years separation (no consent from the defender will be required) - the fee would be £111.

If there are no outstanding financial matters, and they didn''t obtain a Separation Agreement then a short letter confirming that that there are no unresolved financial matters from the marriage is usually accepted by the Sheriff Court.
