Hi I am in the process of divorcing my husband we have just had our first financial appointment and hes insisting i sell the house and leave me with nothing so he can walk away scott free. we were married for 17 years

we have a mortgage on house currently 149,000 we also have an £82,000 secured loan on house which which taken out to pay his credit cards of which i am not sure where the money went. The judge has requested he supplies credit card statements going back to before the loan to see where the money was spent.

there is little equity in the property probably 10,000 at the most and he wants the house sold and half of any equity, so hes clear of all debts giving me nothing.

he earns £69,000 i earn £36,000
he moved out into a rented 3 bedroom detached we have shared care of the kids im paying the full mortgage and loan on house which is 1,400 a month plus all bills etc he pays me 155.00 towards the bills and 344.00 child maintenance that he was requested to by child maintenance.
he has totally embellished his expenditure on his form E

He has a final salary pension CETV worth £149,000 mine is worth CETV £10,000

I want to stay in the house with the children but cannot sustain paying all of this out,

we have our FDR probably may or june time what can i expect, i cant afford to rent anywhere as we did have an IVA and the estate agents are insisting 6 months rent in advance as a deposit which I do not have.
is it reasonable to request to stay in the home and request spousal maintenance from him until my children finish full time education.

any help is appreciated

Hi Gingerbread008

What are your ages, and ages of your children.

17 years is a long marriage.

What is your net monthly income from all sources with benefits and child maintenance, what are your reasonable monthly outgoings as per your needs schedule if you were to remain living in the FMH. If don't want to put the figures here, what is the deficit between income and expenditure, ie.. how much each month would you need to pay all your expenditure?

When was the £82,000 loan taken out, Is the house in your joint names?

Best Wishes
Deborah
