Hi, could anyone answer me a question regarding mortgage capacity ? Does providing this information actually work in my favour or not ? The equity held between us (property, pensions, savings) amounts to roughly £230,000. She is currently living in the property (no mortgage) whilst I am renting a flat. There are no children to consider.
Would providing mortgage capacity information give me less of a share of that equity held between us ?

If you could keep the answers simple i'd very much appreciate it.Thank you.

I was in the same position as you, and we each had to supply our mortgage capacity.
I was private renting and my capacity was 0.
Ex was in paid for FMH mortgage free pad, and could borrow 90k.
This is what happened for me to get my cut, as it had blown a lot of the savings. (Could have paid it all with no mortgage had it not been living the high life).
So now I have bought and am mortgage free, ex stayed in its castle and now has a 90k mortgage against it.
Basically you both need to be housed. If there are children they need a room too. Personally I would opt for you can’t borrow much!

No you've misunderstood.

In your example you currently have a FMH with £150k equity.

Say you can each raise a £75k mortgage then your ex would raise £75k against the FMH to give you your share.

You could then use this as a deposit so you too have a £150k house with a £75k mortgage

Thank you WYSPECIAL. So how would things pan out for me say, if I could get a mortgage offer for £150,000 but she could not get a mortgage at all due to age/low income. Even though the FMH has been paid for and we are tenants in common on the deeds ?

You need to post more details of ages, incomes and all assets plus length of marriage/cohab.

You each need a 1 bed home to live in which doesn't necessarily need to be owned.

She is 58, Income approx. £20k p.a. Assets unknown but not very much at all in savings £5k ? Car £4k

Me 53. Income £34k p.a. £60,000 pension cash value. £14k pension accrued before marriage. £20k in shares. Savings approx. £6k. Car £6K

The FMH is valued at £135.000 (no mortgage)
I have been offered a mortgage capacity of £135,000 over 15 yr repayment plan.
From what I can gather the mediator has not asked my estranged to obtain a mortgage capacity statement. Married in Aug 2005 (13 yrs)

I am renting a 1 bed flat at £550 pcm and total monthly outlay is approx. £1000 pm.
If there's any other info required please don't hesitate. Thanks for your help.
