Yes I was the sole earner through his 3 years at uni.

No I didn’t get solicitor advice, due to a domestic abuse case on going between us involving police I wanted it over ASAP and was originally happy to just walk away with 55% equity share in our jointly owned home

I sold the house to have no financial ties left to him, he was refusing to pay for any marital debt which came out of my account and so that on top of the mortgage was crippling me month on month as it was a large house with a large mortgage.

We exchanged financial info. I had 12 months worth of statements and he has mine, I know he has no savings, just as I have none.

7000k credit card debt was for furniture, it was in my name and he had a named card on that account. I kept the furniture as he left and washed his hands of all belongings, he felt as I kept the furniture (most of which has now been sold on eBay due to lack of storage) then I should be liable. It is marital
Debt, I could argue that and prove it. But felt it easier to accept - higher % of equity and sort the debt myself

I get maintenance of £259 a month, that’s it.

The priority is to house the children and the parent with care.

If the children are the same gender the strict need is a 2 bed place; if different it is 3 beds. What would that cost to buy?

We are both 33 and working full time, he is university educated, I worked whilst he studied and went part time to look after the children for 4 years when they were born, now back working full time.

Two boys aged 5 and 9

Married 13 years together 15.

My income £1500 per month plus £260 maintenance £130 child benefit and £60 universal credit £1950 total

Ex income £2300

Former family 4 bedroom home sold for £220k, £40k equity from that currently held with solicitors

My pension CEV £36k

Ex pension CEV £30k

I have no savings, no assets, debt of £6k in sole name.

Ex has no savings, one property in sole name which he bought for £120k when separated but still married, equity in that is £10k, debt of £7k.

I am living with my parents as I can’t buy until the equity is released. Average house price in my area according to online sources such as zoopla or up my street was £180k, I would need to put down at least 10% deposit to be able to afford a mortgage on a house worth that much.

Children live with me 4 days and him 3 days per week.

It states online the Average house price in my town is £180k. If I look closer at specifics then the cheapest 3 bed in my sons school catchment is £170k, most are around the £200k mark. If I really had to move outside catchment But stay within 5 miles for example could get a 3 bed for between £140k and £160k but would need work.

Assuming I had no debt, the most I could borrow is £125k, if I calculate it and include the minimum credit card payments I have currently as a monthly commitment then it gets reduced to £95k

If the children are both boys, your strict need is a two bed place. Is shared ownership an option?

As you can get a bigger mortgage if the debts in your name are cleared, it would make sense for that to be done from the equity.

He already has £10k equity and his housing needs are met.

I would suggest that a sum sufficient to allow you to buy a suitable property would not be unreasonable. This may mean you retain all or most of the equity from the fmh.
