how come you can divorce after a year apart?

In Scotland the law is different and the facts used as evidence that the marriage has broken down are one years separation with consent from the other spouse, two years separation without consent, adultery or unreasonable behaviour. There is a strong burden of proof required for the last two so most couples (over 90%) divorce on one of the two separation grounds.

If there are no outstanding financial matters to resolve or children under 16 the Simplified Divorce Procedure can be used as Ruby outlined above.
