no acknowledgement from respondent

my husband has not acknowledged the service. I know I have to now apply to the courts as if it has been acknowledged and pay a fee of £40.00. I presume that the divirce will then proceed to the next stages? He thinks that he can stop the process by not acknowledging the service, which is ridiculous as he left me for another woman and is practically living with her. Am I right in my presumption?

If he is saying he has not recived it have a court balif serve the papers there is a fee but once its done the clock starts.

It appears that the court misled me when I teleponed them on friday 29th Feb. Today they told me that he had acknowledged the petition but had made some mistakes on his reply. I am supposedly due an answer in 10 days from posting back the acknowledgement by the courts which was on the 18th Feb.Today is day 10, yet they didn't offer any more info. I shall ring back tomorrow and hopefully get an accurate reply as to where I now stand.I thought by dealing with the courts myself I would have a better idea of where I stood regards progress or lack of, seems not quite so.
Does anyone know where I stand if I'm able to persuade the mortage co to accept my half of the mortgage as it seems the stbx will cease contributions of £400 a month and I'm struggling to make ends meet?
