Hi Folks,

I separated from my wife 7 years ago, about 4 years ago I applied for divorce based on two years separation, my wife denied receiving the document and instantly filed for divorce on terms of adultery. As I simply wanted to be divorced, I agreed to it and filled in the forms. Here we are four years later, she has moved and not informed her solicitors and NOTHING has happened with her divorce petition. I still really want to be divorced so applied in my local court based on five years separation and was told that the previous divorce petition needs to be dismissed using a D11 form.

I can't find any help in filling one of these in, does anyone have a template or example (without names or dates) that I could use as an example.

Your help is much appreciated.

Form d11 is notice of application you can view a blank version on the LSC web site just google lsc and search d11 and you there.

Hi, yes I already have the form... what I need is to understand the method of filling it in. The blank form doesn't give me much further information.

Basically, my other half filed for divorce and hasn't done anything further. I want to counter file but have been advised that I need to have the previous petition dismissed.

I need to know HOW to fill in the D11 form to ask for the previous petition to be dismissed.

You might have to check first that you as the respondant can get the petition dismissed. It may be that the petitioner has to do it and I've been told there's a cost of £80.

Yep... already checked that, I can get it dismissed but I will have to pay £80 to do so. Really, all I need is an example of a filled in form so I know what to put where and the sort of language to use.

Can anyone help?

I am unable to help you with filling in the form but can you tell me why you can dismiss the petition when you are not the petitioner? I think the court will have to refer it back to her if you try to do it.

Ahhh... I have been told by courts that because she has not continued with the divorce, moved house and not informed her solicitor that based on 4 years of inactivity, I should be able to get it dismissed. They may write to her but I doubt they will get a reply. I am not entirely sure what will happen then but I guess if there is no reponse for a given period that they will do the deed.

On this basis, is there anyone who has filled in one of these forms who might be able to give me any help??
