D8 form part 10 court fee

Hi all

I ticked D8 form part 10 (2)
which make respondent pay the court fee.

I sent to form to court and court sent form back to me saying I need to send GBP 340.00 cheque payble to them.

I thought they will ask respondent to pay it.

Did i have to ask my ex for cheque and send to court myself ?

Hope someone answer me and give me some advice.

You can claim the costs back afterwards which is why you are giving the option of ticking the box to claim for them it gives him advance warning you expect him to pay the costs.

If he is willing to pay the fees up front you will have to tell the court he has paid this, there will be additional fees on top of your initial Petition.

So basically I need to paid them first
by sending cheque to court.

and then my ex reimburse me later..

Unless its a five year separation or you have agreed to split the costs the Petition claims the costs back from the respondent.

As you are making the petition if do not have an undertaking that he will pay the costs you should apply for them in your Petition.

The initial petition is £340 as well as an application for your Decree Absolute which is another £45.

If you are looking for any kind of financial settlement there will be additional costs involved in agreeing this.

Is it a short marriage are there any children involved are you seeking maintenance as well as this would involve addition costs in making an application.
