Hi,

Hope I can get some help. I am doing divorce side of things myself and have received the forms to apply for the Nisi.
I am still under the same roof as my STBX. I petitioned the divorce in February therefore only a month ago, however the form asks if I have lived at the same address as the Respondent for a period of 6 months since divorce petition? Is this a simple case of answering No
?? It is confusing as then it goes on to ask about the arrangements for sharing the accommodation which we still are.. Do I need to fill that part in even if I am saying no...

Many Thanks for any help!

Hello season5

My understanding is that it is preferable to be upfront and acknowledge in the form that you are indeed living under the same roof . Then you can expand in the section you mentioned on arrangements to show that you are living separate lives: such as not cooking for one another, sleeping in different beds, not socialising together, not doing their house chores etc

I hope this helps

Thankyou for your reply. yes I don''t deny that I would need to let them know we are still both in the same accommodation, however it is not 6 months since my Petition which the question states, so do I say no but then continue to explain the arrangements? Neither of us has ever left the accommodation so would the dates be from when we first moved there? Or is it easier just to say yes and state the dates etc. I really need to get this in the post but this question is my only sticking point..

Thankyou again for your time! :)
