Hi can anyone tell me once the Divorce papers have been sent. How long before you go to the next step and what is the next step you have to take if your spouse has not done anything about it. He has received the papers but refuses to acknowledge them

If he refuses to acknowledge the papers you need to have the papers served by a bailiff or a process server. You can then apply for deemed service based on the evidence of the bailiff or the process server.

Thank you Charles. Is there a time limit in which I have to take the next step. Its just that he keeps saying that he will send them back but then he doesn''t. He got the papers middle of September.

There is no time limit as such although the time that is allowed for the respondent to file an Acknowledgement of Service is short at 8 days.

Did you make a claim for costs within the petition? If you did, you could mention to your ex that the costs will increase if you have to have the Petition served upon him.

yup but that 8 days limit doesn''t seem to make any difference, there isn''t any penalty for ignoring it - so it seems. My ex has had these papers for 11 weeks + and has just seen a solicitor to get advice. That solicitor has now made conditions which apparently I have to agree to before the Acknowledgement of service is returned!
