Hi,

Please can anyone tell me if I can successfully file Form A (requesting financial consent) before the court has received acknowledgement from my divorce petition?

The deadline to file for financial consent ends shortly (4 months after mediation broke down) and I want to know whether it will be accepted if my divorce hasn't been acknowledged yet.

Thanks!

Hi

I don't believe so, you may need to get the Petition served if it's not being acknowledged.

I'd wait for a couple more experienced people to reply though as I'm not 100% sure.

Cheers

Thank You - it's encouraging that at lest you think the same as me.

My husband's solicitor wrote to me to say they had acknowledged at the court but I have today contacted the court and they haven't received it (It was sent nearly 2 weeks ago)!

Grrrrrrr - sooo frustrating!!

I'd really appreciate any comments on this one. Thanks!!

My acknowledgement took a year. Six months where stbx didn't sign which meant serving...twice! Plus six months where the court had the acknowledgement but didn't send it to me, with no apology of course.

I'd say keep chasing up the court.

You can't start financial proceedings until you have your Decree Nisi. Hope this helps.
