Dear All .
separated April 2022 ,sold house .October 2022 ,couple of questions
1 ,
page 5 of the D81 current capital and income ,is this where we put the sold price of the house and how we split the proceeds 50/50 and what each party had cash capital etc ,and all section up to 10 as the situation was then .
2; then in section 10 we put how we split the proceeds etc and what our income and savings are as of todays date ,
my partner has inherited since our separation and I have been informed was / had been hiding money from me ,does she have to disclose this on the form D81

Presumably you are getting a Consent Order drafted now.

Table 8 should contain the asset split just before the Consent Order - ie as it is now in Feb 2024.

Table 10 should contain the asset split after the Consent Order - i.e. what it will be in March 2024.

As you already split the proceeds in Oct 2022 and split the money, if you do not intend to pay each other any further lump sums - then the figures in table 8 and table 10 may well be the same.

In question 12 you can briefly explain when the house was sold and how you split the proceeds.

Thank you ,and what about the money she has kept from me or the inheritance ,how can it be a full disclosure of money if she does not put that down somewhere ,I cannot see how it’s possible to have a Clean Break but Not disclose everything ,as with most things ,,,it’s not what you put down ,,,But what you Don’t include that’s important ,,again many thanks for your reply

Just had a look at the draft consent ,and this line says
(The parties have made complete fair and accurate disclosure to each other on All financial matters in this agreement) well she has not .so do I need to challenge that first , thank you again for your continued help ,very much appreciated
