Hi - my ex and I want to get a financial Consent Order for a Clean Break with our divorce. We have no shared assets and neither of us are claiming maintenance or any payments. No children, no property.

For Form A - there are two questions which are confusing. Any help would be much appreciated!!

Under 'Nature of Application' - it says 'tick the statement that applies': the applicant intends to:
  • I chose: "proceed with the application in the" and then "divorce"
The second column then says "tick one or more of the following orders" - however, none of the options seem to be applicable in my case. A lump sum order is probably closest but we have already divided everything we have and there is nothing to pay out.

Q: Can I just leave that second column blank or should I tick lump sum order?

Under '2. Requirement to attend a mediation Information and Assessment Meeting (MIAM)', it says :"You must have attended a MIAM before making this application unless the requirement to attend a MIAM does not apply because the financial order you are applying for: is for a consent order". So for:
  • 2A - I chose 'No'
  • 2B - I chose 'No' but then it says next to it that I can't make the application if I chose no...
It also says all applicants must complete this section - so I'm not sure what to do?

Q: Do I chose 'NO' for 2A and 2B and submit the form anyway, or do I leave this blank?

Thank you for your help!

Look at form D81 which will hopefully set you in the right direction.
