Stbx is refusing to budge on 50/50 share of assets which will leave him in a significantly better financial position than me and our children.

His solicitor has so far taken over a month to reply to my last letter regarding a financial split, meanwhile my credit score is plummeting as we are living hand to mouth with no financial support from him.

I had considered mediation but was horrified to see the costs. £330 per 1.5 hour session plus VAT. There is no way I can afford even half of that. I read that you can apply for legal aid for mediation but all the places I have looked at have said you will be assessed at your first meeting. I can't afford to even pay for that first meeting so is there any way around this? I don't even understand how the Legal Aid system works.

I've just found out that my landlord is planning to sell the house we are living in and on my pay I can only afford a one bed flat for the 3 of us so I need to get this sorted out as soon as I can so we can move.

Any advice gratefully received. Thanks

If you call the Wikivorce helpline on 01202 805020 we can arrange for you to have a legal aid pre-assessment over the phone with a mediator to see if you are likely to qualify for legal aid.

Hi I think you should go and see your local councils housing department - you will effectively be homeless. The have a duty to house you and your children.

I was a very similar situation, but I have just been given a lease on a 3 bed property for myself and my 3 kids that I can afford.

They should also help you sort out benefits too

Thanks Jedzy, unfortunately I earn just over the threshold for benefits . I am entitled to about £2 a week of housing benefit which I don't claim as it would cost me more to claim it than I would get. The cost of renting privately is astronomical and leaves me with only a couple of hundred pounds to pay my bills and help out my kids. Their father contributes nothing.

Also as my children are at university the Council would only have a duty to me and not to them which would, essentially, leave them without a home to come back to in the holidays. My council won't even consider housing you unless you have exhausted every option with friends and family and without young children I would be a very low priority.

If I can get the division of assets sorted out it would give me enough money to look at shared ownership as I don't want to stay renting.

Mjay,just to let you know that the council do include children at Uni as part of their calculations. I would check that with the CAB to be certain but I have always been told that they are.
