I have been going through the process of divorce and it’s not been an amicable process from the start. He did not acknowledged the divorce petition from my solicitor and now not acknowledging it from the court . I have arranged as per court requirements mediation but he did not respond to the mediator.
She signed my documents and it’s been sent off to the solicitor.
Just wondering if the court will look into this as to his disadvantage that he didn’t bother to attend?
It won't make a difference to any outcome. The thing is that when you are in the court process he will be answerable to the court and not you. If he fails to engage then the judge will deal with him. It opens up the possibility of a costs order as well as a penal notice which could eventually end up with him going to jail if he persists in failing to provide the necessary documents etc.
In reality this rarely happens.. If he doesn't produce the initial financial disclosure documents etc in time for the first hearing the likelihood is that it would be adjourned for a month to give him the opportunity to do so - and there may be a costs order against him for a wasted hearing.
