New Relationship = Adultery?

My ex served Petition against me on grounds of unreasonable behaviour at the same time as commencing new relationship, I agreed as keen to move things along and not contest divorce and I was unaware until recently of that new relationship. The Decree Nisi hasn''t yet been granted but he considers he hasn''t commited adultery because he served the petition before commencing the new relaitonship.

So my question is, is a new relationship before the nisi (or before the absolute) adultery or not?

If you have a sexual relationship with someone else while you are married, that is adultery. However the reasons for the divorce have no bearing on any financial settlement so who divorced who and why is irrelevant.

Technically yes it is adultery. But also technically, the grounds for divorce are supposed to be the reasons the marriage broke down. The marriage can''t have broken down due to his adultery, since his adultery started after separation.

Anyway it''s irrelevant, the divorce is going through on your UB. There''s absolutely no point in now saying "oh but he is committing adultery". It will achieve nothing, except to clog up the entire process, and cost you time and money.

I accept and agree with everything you say. I asked only from a point of curiosity really ~ I have no problem with his new relationship, I just wondered when it is or isn''t officially classed as actual adultery. What''s more frustrating is that my so called unreasonable behaviour was only ever in direct relation to his own unreasonable behaviour. Such is life :unsure:
